CYO ("Create Your Own", "we", "us" or "our") offers personalized fine jewelry using a made-to-order model via a digital design process. Each piece is crafted based on your chosen design, material, and confirmed specifications. "You", "your" or "customer" refers to any person using the website or placing an order.

The use of our website and all products and services offered through it are subject to these Terms and Conditions, our Privacy Policy, and all other policies referenced on the website. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website.

You also confirm that you are legally capable of entering into a binding contract. Continued use of the website will be deemed acceptance of updated versions of these terms. Material changes will be communicated via email or website update. CYO reserves the right to refuse service at any time at its sole discretion.

Privacy & Data Usage

At CYO, privacy is treated with the same care as each of our pieces.

We collect personal data to enable you a secure, smooth, and personalized experience. This includes name, email address, shipping and billing information, telephone number, IP address, and account data. Payment information is processed exclusively for the purpose of completing your transaction.

Additionally, we may collect preference data, browsing behavior, device information, and your communications with us (e.g., reviews, messages, surveys) — for order processing, experience optimization, fraud prevention, and further development of our platform.

We do not sell your data. Disclosure occurs exclusively to trusted service providers (e.g., for payment, shipping, IT) who are contractually obliged to process data confidentially. Full details can be found in our Privacy Policy.

Account & User Obligations

You can create a CYO account to place orders, track your pieces, or participate in exclusive releases.

You are responsible for the security of your login credentials and for keeping your information up to date. Accounts may not be used without permission. CYO reserves the right to suspend or delete accounts for violations of these terms.

Products & Orders

All CYO pieces are intended for personal, non-commercial use. We strive for the highest accuracy in product descriptions — nevertheless, slight deviations in color, size, or availability may occur.

Before completing the order, you have the opportunity to review or adjust your details. By submitting the order, you make a legally binding offer, which leads to a contract upon our acceptance.

Communication is partly automated via email. Please ensure that your email address is correct and that you can receive messages.

CYO reserves the right to modify, reject, or cancel orders if fraud is suspected, or in case of pricing errors or availability issues.

Prices & Payment

All prices are in EUR, unless otherwise stated. We accept common credit and debit cards as well as selected payment providers.

Payments must be made in full before production begins.

For instant payment providers (e.g., PayPal, Amazon Pay), processing is done via their platform. In case of an error (e.g., pricing error), CYO may adjust or cancel orders — any payments already made will be fully refunded in such cases.

Custom Jewelry

You are responsible for the completeness and accuracy of your information during the design process.

You undertake not to submit any content that violates third-party rights or applicable law, and you indemnify CYO from any corresponding claims.

If a design proof is provided, production will only begin after your final approval. After approval, responsibility for the correctness of the information lies with you. CYO assumes no liability for errors that were not identified before final approval.

Shipping & Delivery

Orders are shipped via trusted logistics partners. Delivery times are estimates and may vary depending on the region, customs, or logistics.

The risk transfers to you as soon as the goods are handed over to the shipping service provider.

Should a product not be available, you will be informed, and any payments already made will be refunded.

International deliveries may incur customs duties, taxes, or import costs. These are the responsibility of the customer.

Warranty & Repairs

CYO offers warranty and repair services for demonstrably defective pieces — subject to inspection.

Shipping costs for returns are borne by the customer. If a defect is confirmed as a warranty case, CYO will cover the repair and return shipping.

Damages due to improper use, unauthorized intervention, or normal wear & tear are not covered.

Returns & Refunds

Refunds are only possible in the event of significant manufacturing defects or demonstrable loss during transport — and always require an inspection.

For all claims, a complete, uncut unboxing video is required, showing the sealed package before opening and clearly documenting the defect.

A refund will only be issued for:

1. significant manufacturing defect,

2. immediate notification after delivery,

3. return for technical inspection.

Refunds will only be processed after physical inspection and written confirmation. CYO may initially offer repair or replacement.

Shipping costs, customs duties, taxes, fees, and administrative costs are non-refundable.

In case of loss during transit, a refund will only be issued after official confirmation from the shipping service provider.

Promotions & Promo Codes

Discounts and promo codes are subject to individual terms and may be time-limited. Codes have no cash value and are not combinable unless otherwise stated. CYO may reject invalid or misused codes.

Marketing Communication

By signing up for SMS or other marketing channels, you agree to receive updates, offers, and service messages. You can unsubscribe at any time (e.g., via "STOP" for SMS). Standard charges from your mobile provider may apply.

User Content

If you share content (e.g., reviews or images with CYO pieces), you grant us a non-exclusive, royalty-free right of use for branding and marketing. You confirm that you own the rights to the content and that no third-party rights are violated.

Intellectual Property

All content, designs, and trademarks on the CYO platform are the property of CYO or licensed and legally protected. Any commercial use without express consent is prohibited.

Limitation of Liability

CYO is liable only within the scope of legal provisions. Liability for indirect damages, lost profits, or data loss is excluded. Maximum liability is limited to the purchase price of the respective product.

Website Availability

CYO may at any time restrict or discontinue parts of the website or the entire service. Certain products or services may not be available regionally.

Applicable Law & Jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction is Berlin, unless mandatory consumer protection regulations dictate otherwise.

Final Provisions

Should individual clauses of these General Terms and Conditions be ineffective, the remainder shall remain unaffected. These General Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and CYO.
